It's certainly not a legal test, but as a rule of thumb consider whether, if your painting were put next to the painting or photo you're copying, would someone say you'd based it on the original? If so, you're risking copyright infringement. Don't fool yourself with this 10 percent change myth.

Then again Transformice has copied a lot of stuff from other games with the stuff in the shop, so wouldn't be such a good idea to care about disney doing this.

This is a paragraph from clause 3 in Disney's Terms of Use:

Pretty simple to work out whats happened; Someone made an animation based off Meli's artwork, Disney saw it and decided it would be perfect to use for their ad. I doubt the people in charge of co-ordinating the ad even recognise it as Transformice and I doubt Disney would allow them to make such a mistake if they did know. Silly on their part for not researching it beforehand I guess.

Whether it's a breach of copyright or not and what options Atelier801 have if it is i'm not fully sure of, but if we were to ask ourselves "Would a third party recognise and associate that ad back to Transformice" the answer is no. Of course we all recognise it instantly and relate it with Transformice since we use Transformice extensively enough, but the general public wouldn't see the connection.

Since I remember Meli said that theres no point of suing the creators of that game which clearly copied tfm, but it was squireels...because it would probably take a long time and they were from russia, so it wouldve just been trouble.

The refrence was probably a fanart of Transformice on the drawing and they didn't look at the name of what the person of the art called it.
It is possible Disney violated the rules of Copyrighting, but i'm sure Sydo will see the commercial, then contact them about the situation. I say we shouldn't worry about it, since it's not our buisness, it's more likely the Transformice Teams buisness to see it.
Either way, we should contact Sydo and tell her, I'm sure she'd do something if Disney didn't ask, but, it was probably just a mistaken fanart they thought they should of used, then they didn't research.
We are Transformice Players,. so we can tell when we see our mice, general people do not.
